Case to ban junk foods near schools receives boost

In a move that could make the going tougher for food processors in their fight against a possible ban on the sale of junk foods in and near schools, a prominent Indian school has asked to be made party to the legal case.

The Delhi High Court said today that it had admitted a plea by the students of Father Agnel School, a national chain of convent schools, asking to be heard out before passing any order in on a Public Interest Litigation (PIL) seeking the ban.
The PIL was originally filed by a Delhi-based non-governmental organisation, Uday Foundation, a year ago where it asked for the sale of junk food and aerated drinks to be outlawed in schools as well as within a 500-metre radius. ....read more






India ponders sugar deregulation in 2012

The Indian Ministry of Food is in discussions with state governments and associated ministries to remove controls over the country’s sugar industry in the new year.

Food minister K V Thomas said on December 22 that his ministry was talking to the Ministry of Finance and the Ministry of Agriculture over deregulating the sector, beginning with the removal of levy sugar in the new year.
The Indian sugar industry currently is obligated to supply 10% of its output to the government of India, which is sent to the country’s Public Distribution System. This 10% is known as levy sugar. .... read more

Coke sees fizz in Indian non-fizzy drinks market

Coca-Cola India has set up a division to innovate, sell and distribute juices, energy and powder drinks in order to garner a higher share of the growing non-fizzy drinks market in India.

According to Coke spokesperson Kamlesh Sharma, the new division will lean on the existing supply chain infrastructure and capabilities in manufacturing plants, depots and other backend infrastructure to source its supplies and service the markets.
“Work has progressed within the new vertical on appropriate sales routines, processes and practices. It will be operationalized in phases across different geographies in India over 2012-2014 and will cover all markets,” he told FoodNavigator-Asia.com .....read more

Hostility towards FDI will not put off internationals

India’s foreign direct investment (FDI) law for its retail sector was put on hold earlier this month following political opposition, but this will not impede internationals entering, according to analyst.

The decision to open up India’s $450bn retail market, allowing 51% FDI for internationals, reached a stalemate earlier this month with pressure from coalition allies as well as the opposition party.


Clive Black, head of research and retail analyst at Shore Capital Stockbrokers, told FoodNavigator-Asia that the decision to postpone the law will not put internationals off.
Black said that the market is very complex administratively and that, “any internationals that are interested in India are very alive to the reality; they have done their homework.”   .... read more

Indian state brings the ‘death penalty’ hammer down on illicit liquor

The western state of Gujarat has passed one of the most stringent laws in India against illicit liquor, as the death toll from consumption of the toxic ‘hooch’ in the eastern state of West Bengal reaches 170.


A spokesman at the office of the governor of Gujarat, told FoodNavigator-Asia: “The Bombay Prohibition [Gujarat Amendment] Bill of 2009 has been finally given assent by the governor after initial objections..”
Under the bill, any person found manufacturing, stocking or transporting illicit liquor like hooch without a license can receive the death penalty or life imprisonment in Gujarat if consumption causes death .....Read More

Amul slams Nestlé over trademark infringement

NestlĂ© India has been threatened of court action by Amul, India's largest 
 dairy cooperative, over the Swiss food major infringing on the latter's trademarks in the country.

Amul is the brand name for the Gujarat Cooperative Milk Marketing Federation (GCMMF), which has been selling milk, butter, cheese, and ice cream products in the country since 1946, sourcing from three million milk producers.

Food Safety & Standards Act,2006.

Food Safety & Standards Authority of India.











The Food Safety and Standards Authority of India (FSSAI) has been established under Food Safety and Standards Act, 2006 which consolidates various acts & orders that have hitherto handled food related issues in various Ministries and Departments. FSSAI has been created for laying down science based standards for articles of food and to regulate their manufacture, storage, distribution, sale and import to ensure availability of safe and wholesome food for human consumption. 

Highlights of the Food Safety and Standard Act, 2006 
 Various central Acts like Prevention of Food Adulteration Act, 1954 , Fruit Products Order , 1955, Meat Food Products Order , 1973,
Vegetable Oil Products (Control) Order, 1947,Edible Oils Packaging (Regulation)Order 1988, Solvent Extracted Oil, De- Oiled Meal and Edible Flour (Control) Order, 1967, Milk and Milk Products Order, 1992 etc will be repealed after commencement of FSS Act, 2006.


The Act also aims to establish a single reference point for all matters relating to food safety and standards, by moving from multilevel, multi-departmental control to a single line of command. To this effect, the Act establishes an independent statutory Authority – the Food Safety and Standards Authority of India with head office at Delhi. Food Safety and Standards Authority of India (FSSAI) and the State Food Safety Authorities shall enforce various provisions of the Act.
